McCURRY WINS ROWS WITH McDONALD’S : BBC NEWS 8/9/09

The American fast-food giant McDonald’s has lost an eight-year legal battle to prevent a Malaysian restaurant calling itself McCurry. McDonald’s argued that the use of the “Mc” prefix infringed its trademark. But the Federal Court in Kuala Lumpur ruled that there was no evidence to show McCurry was trying to pass itself off as part of the McDonald’s empire.

The owner of McCurry insists its “Mc” prefix is an abbreviation for Malaysian Chicken Curry. Long process McDonald’s, which has more than 180 outlets in Malaysia, first sued the McCurry restaurant in 2001.

McDonald’s has more than 180 outlets in Malaysia A High Court ruled in favour of the international chain in 2006, but then McCurry took the case to the Court of Appeal, which overturned the ruling. McDonald’s then went down its final legal avenue, taking the case to the Federal Court. But chief judge Arifin Zakaria said on Tuesday that the three-member panel had unanimously dismissed the application. “We feel great that this eight-year legal battle is finally over,” McCurry owner P Suppiah told reporters. “We can now go ahead with whatever we plan to do such as opening new branches,” he said.

McCurry opened for business in Kuala Lumpur in 1999, and serves Indian dishes, including fish head curry and breads including tandoori naan. Lawyers for McDonald’s told the Associated Press news agency that the company accepted the judgement.

Hotter and drier days ahead with El Nino

KUALA LUMPUR: Malaysians can expect hotter and drier days till September as an El Nino phenomenon is forming.

While the real extent of the El Nino impact could only be gauged sometime in August, more open burning was expected to contribute to more haze, the Meterological Department said in a report.

Malaysia experiences a hot and dry season in the months of June, July and August and temperatures range between 33C to 34C.

It is understood that temperatures could soar another 3C during El Nino.

Natural Resources and Environment Minister Datuk Douglas Uggah Embas said the ASEAN Specialised Meteorological Centre (ASMC) satellite report had identified 125 hot spots in the country since May 25 to June 7.

“The ministry has taken a pro-active measure by reviving the committee which monitors hot spots.

A national haze main committee meeting was held in February and June 8 and local government agencies have been ordered to be on a stand-by for any eventuality,” he said after launching the ‘Genting Goes Green’ at First World Plaza, Genting Highlands Resort Tuesday.

In a further preventive measure, the ministry has continued to increase its monitoring on the situation via daily aerial surveillance with co-operation from the police air unit and private airline companies, said Douglas.

“Emphasis is given to areas that are prone to fires such as Selangor, Pahang and Johor, especially peat swamps and garbage landfills.

“We have also roped in commercial airlines such as Malaysia Airlines and AirAsia to help report open burning cases that they spot while up in the air,” he said.

The ASMC report also showed that there is an increase of hot spots in Sumatera and Kalimantan, Indonesia, totalling to 996 and 108 hotspots.

Douglas added that the country’s Air Pollution Index (API) has slightly deteriorated and now stands at 51 to 100, which is moderate.

“This has caused it to be slightly hazy. This hazy situation happened because of a stable atmosphere with a high humidity level of above 85%.

“This leads to air pollutants such as dust and emissions from vehicles and industries to collect and continue increasing in the air space, thus causing poor visibility,” he said.

According to a Meterological Department report on June 8, visibility at certain areas in Prai, Bayang Lepas, Subang, Petaling Jaya, Malacca and Kuantan has deteriorate to between 6km to 9km.

Singapore replaced their old 2 units of American Made AWACS, Grumman E2C Hawkeye with 4 units of newly advance Israel Aircraft Industry (IAI) G-550 CAEW/C equipped with ELTA M-2075 Phalcon AESA ( Active Electronic Scanned Array) and these G-550 is already equipped with ELTA SEMA (Special Electronic Missions Aircraft) which capable to jam and retard enemy communication devices within 100KM radius or more!! .It is the second after  ‘mythical’  Electronic Magnetic Pulse (EMP) shield system which is said, being used in USN Aircraft Carriers.

Military experts says, 1 unit G-550 CAEW/C can replace 2 units of E2C and with 4 units of G-550 CAEW/C , Singapore now will have the total superior control over west South East Asia’s airspace.

So, i wonder when Royal Malaysian Airforce will start joining the league of ‘Electronic Warfare’??

We dont even have AWACS (or AEW) aircraft. I remember in 1996 there was a proposal to buy Swedish ‘s Saab 340 AEW Erieye (Codename, S-100B Argus) for RMAF, but in the end, nothing happened.Like always.

Undergrad sues UiTM over molest

SHAH ALAM: A second-year undergraduate is suing Universiti Teknologi Mara (UiTM) for negligence after a man entered the girls’ hostel and sexually assaulted her in the bathroom.

The 21-year-old hotel and tourism management student is suing the university after she failed to get answers from the university administration about the incident. She filed her suit at the Sessions Court here on Tuesday, claiming general, exemplary and aggravated damages.

 She claimed that in the incident in November last year, a man dressed as a woman wearing a black bra went into the girls’ hostel and tried to rape her. According to her police report, she was having her bath at 5am on the second floor bathroom of Kolej Seroja in the Section 7 campus.

She said someone knocked on the cubicle door and when she asked who it was, the person asked her to open the door. She described the voice as that of a man trying to imitate a woman. When she refused to open the door, the man forced it open.

 She said a naked man barged in and molested her. She screamed for help but nobody came to her aid. She managed to run out of the cubicle but slipped and fell at the bathroom entrance.

 The student said the man also ran out of the bathroom and minutes later, other students saw a man wearing only shorts and a black bra walking out of the hostel. Shah Alam member of parliament Khalid Samad and the student’s lawyer, Mohamed Hanipa Maidin, revealed this at a press conference here yesterday.

The victim was not present. Hanipa said the university only gave his client extended leave when they should have given her proper counselling and investigated the incident.

 Khalid said the victim’s family approached him for help in December last year and Hanipa had sent a letter to UiTM asking them for more information and damages. “But there was no response. We were left with no choice but to file the suit,” he said.

When contacted, UiTM legal adviser Dr Aidar Dziyauddin said the university had yet to receive the court documents. He said he needed to go through the statement of claim before he could comment on it.

This is not the 1st time la, UiTM Shah Alam oii!!..we ‘ve heard this before and in 2003 there were serial cases where the girls were being raped in their own room. Remember ‘Kolej Mawar Rape Cases’? No action were taken by Ibrahim Abu Syah’s administration.All they can say is “..it was just a rumours and if it is really happened,..it is just an isolated case..” ..WTF!??

So there you go. Now you got it. A really big smack in your face.You asked for it. The girl should claim millions buck from UiTM Shah Alam for negligence and breach in security.

Talking about UiTM Shah alam security, who can forget the famous ‘UiTM Pak Guard’? the fierce a la military security force that only concern to penalize the students for tiny felony like not wearing proper shirts, parking tickets and all sort of tiny-minor unlogical things that you cannot think of. Ironically, the foreign construction workers are free to roam in the Uni compound ,going in and out ,without any harrasment from the guards. I m not saying that those workers are the rapist or the molestors but hey, go figure la.Bukak Mata sikit!!

and where are those MPPs (Student Representatives) who supposed to fight for the students’ right to think, learn and express themselves? ..and not to forget, to fight for the  students’ right to feel safe and secured in the university.

Or maybe they just busy pleasing the administration and busy marching on the street of Shah Alam..fighting for Artikel 153?

So, the last time i went for a gig, it was in 2003 and i was still in ITM .It was in Ampang City Plaza and it was a “tribute to Trash-Hardcore-Crossover” gig where i had my last ‘sweaty’ moment in the mosh pitt. The last stage dive and the last slamming.The last moment in the ‘underground’ world.

and the result?…that night, i got a really bad backache and i can’t feel my legs at all. All numb.I guess its how our body try to tell us..” hey, u getting old,man..stop doing the mosh!”

So, now as a working adult, i totally left the pitt.

I love music but Im a not pure musician or an artistic dude that can elaborate a drawings or a weird looking sculptures but i really appreciate live music performances. From Hard Rock to ballads ,from rave to downtempo ,from traditionals to big band ochestra.

Just recently, this year, i found another ‘pitt’ . An acoustic cafe, Cantumas Cafe in Setiawangsa (i mean Seattlewangsa..)KL. A place where a so called working adult like me can sit ,eat ,drink and chill out while listening to nice  local indie music, performed lived that will smoothen your ears after a hard day at the office.

This is where i start to know names like Wani Ardy, Estrella, Bite Me Butterfly,Rivernation ,Kabus and some more local independent (underground??) artistes. Kudos goes to those who wrote and sang their own songs in Bahasa Malaysia.  I am glad to know that , how our music are evolving in the indie scene but i wonder why our radios and TVs still keep playing those Indon songs soo hard?it’s like over and over again. I remember  that even bloody Celcom used that Indon band, Peter Pan, to do cover song ‘ Football Mad Nation’ on TV ads for their UERO CUP 08 promotion. Why didnt they just used the original artistes, Disagree and Pop Shuvit for that TV ads? and MALAM PESTA MUSIC INDONESIA in KL recently?..What the fuck is that!!??

oh yeah..i forgot ..there are about 2.5 millions foreign workers in Malaysia now and almost 50% from that are Indonesian. It is all about quantity and figures.So those mediacos and telcos just doing their job as a fucking capitalist.

Anyway..about this kakak named Yunalis (Yuna). i saw and heard her name at Urbanscapes 08 but i didnt really saw her performance that day.So, i dun really know who she is until a colleague at the office gave me a copy of her EP with self titled; YUNA.  It have 4 english songs with one Malay songs.He got it from his brother and he insisted me to listen to it.i heard she is from Kuantan?
